Makassar – Bayu, pemuda asal Kabupaten Wajo yang sebelumnya dinyatakan hilang setelah dijemput oleh sekelompok orang tak dikenal, kini diketahui berada di Unit Jatanras Polrestabes Makassar. Informasi ini pertama kali diperoleh dari seorang informan yang kemudian dikonfirmasi oleh rekan jurnalis Notifedia pada Jumat (14/3/25).
Kepastian mengenai keberadaan Bayu juga telah diketahui oleh pihak keluarga. Namun, orang tua Bayu masih mempertanyakan prosedur hukum yang diterapkan dalam penangkapan anak mereka. Mereka menilai tindakan kepolisian dalam kasus ini cenderung sewenang-wenang dan tidak sesuai dengan aturan yang berlaku.
“Kami hanya ingin tahu, kalau memang anak kami bersalah, tunjukkan bukti dan proses sesuai hukum. Jangan main tangkap begitu saja tanpa ada surat yang jelas,” ungkap keluarga Bayu.
Bayu sebelumnya dilaporkan hilang setelah dijemput oleh sekelompok pria bersenjata di rumahnya di Kecamatan Maniangpajo, Kabupaten Wajo, pada Selasa (12/3/25) dini hari.
Saat itu, tidak ada surat penangkapan atau pemberitahuan resmi kepada keluarga. Hal ini membuat keluarga Bayu panik dan melaporkan ke Polda Sulawesi Selatan terkait kehilangan anak mereka.
Setelah beberapa hari pencarian, keberadaan Bayu akhirnya diketahui. Awalnya, ia disebut diamankan oleh Polda Jawa Barat, sebelum akhirnya dikonfirmasi bahwa Bayu kini berada di Unit Jatanras Polrestabes Makassar.
Namun, pihak keluarga masih belum mendapatkan penjelasan rinci terkait alasan penangkapan Bayu, termasuk tuduhan yang diarahkan kepadanya.
Berdasarkan hasil investigasi jurnalis Notifedia, pihak keluarga Bayu telah mencoba melakukan komunikasi dengan kepolisian terkait kasus ini. Ada upaya lobi yang dilakukan antara keluarga dan pihak kepolisian, namun hingga saat ini belum ada kesepakatan atau penjelasan resmi yang memuaskan dari pihak berwenang.
“Kami hanya ingin kejelasan, apakah Bayu benar-benar bersalah atau tidak. Jika iya, maka tunjukkan bukti dan beri tahu kami apa yang sebenarnya terjadi,” kata salah satu anggota keluarga Bayu.
Hingga kini, pihak kepolisian belum memberikan pernyataan resmi terkait proses penangkapan dan penahanan Bayu. Hal ini semakin memicu pertanyaan dari masyarakat mengenai transparansi dan prosedur hukum yang diterapkan dalam kasus ini.
Kasus Bayu telah menjadi perhatian publik, terutama terkait prosedur hukum dalam menangkap seseorang yang diduga sebagai tersangka. Banyak masyarakat yang mempertanyakan, apakah prosedur yang dilakukan dalam kasus Bayu sudah sesuai dengan hukum yang berlaku?
Di ketahui dari pakar hukum bahwa penangkapan seseorang harus mengikuti prosedur yang diatur dalam Kitab Undang-Undang Hukum Acara Pidana (KUHAP).
“Dalam Pasal 18 KUHAP dijelaskan bahwa setiap penangkapan harus disertai dengan surat perintah, kecuali dalam keadaan tertangkap tangan. Jika tidak ada surat penangkapan yang sah, maka tindakan tersebut bisa dianggap sebagai pelanggaran hukum,”
Kepolisian wajib memberi tahu keluarga tersangka tentang alasan penangkapan dan lokasi penahanan agar tidak terjadi kebingungan seperti yang dialami keluarga Bayu.
Hingga saat ini, pihak kepolisian belum memberikan keterangan resmi terkait penangkapan Bayu. Pihak keluarga dan masyarakat berharap ada transparansi dalam kasus ini agar tidak menimbulkan spekulasi negatif terhadap institusi kepolisian.
Kasus ini menjadi ujian bagi aparat penegak hukum dalam menjalankan tugasnya sesuai dengan prinsip keadilan dan hak asasi manusia. Keluarga Bayu, bersama dengan kuasa hukum yang sedang mereka cari, berencana untuk mendatangi Unit Jatanras Polrestabes Makassar guna meminta penjelasan lebih lanjut.
Masyarakat kini menunggu, apakah ada kejelasan hukum dalam kasus ini, atau justru menjadi satu lagi contoh dari lemahnya transparansi dalam sistem penegakan hukum di Indonesia.
