Parepare – Lembaga Bantuan Hukum (LBH) PC GP Ansor Parepare mengecam tindakan Dewan Perwakilan Rakyat Daerah (DPRD) Parepare yang menolak pembangunan Sekolah Kristen Gamaliel di Watang Soreang.
LBH Ansor menyatakan bahwa keputusan tersebut bertentangan dengan amanat konstitusi, terutama Undang-Undang Dasar 1945 Pasal 31 ayat (1) dan (2), yang menyebutkan bahwa setiap warga negara berhak mendapat pendidikan dan pemerintah wajib memfasilitasi pendidikan dasar bagi semua warga negara.
Ketua LBH PC GP Ansor Parepare, Rusdianto Sudirman, S.H., M.H., C.Me., menegaskan bahwa tindakan DPRD Parepare tidak dapat dibenarkan dengan alasan apapun.
Ia menilai keputusan menolak pembangunan sekolah tersebut bertentangan dengan prinsip konstitusi dan hak asasi setiap warga negara untuk mendapatkan pendidikan.
“Tidak semestinya DPRD mengambil langkah gegabah dengan menolak pendirian sekolah, apalagi sampai memerintahkan Satpol PP untuk melakukan pengawasan dan pemasangan police line di lokasi pembangunan,” ujar Rusdianto.
Ia menambahkan bahwa Satpol PP seharusnya hanya bertindak jika ada indikasi pelanggaran Peraturan Daerah (Perda).
LBH Ansor menilai bahwa langkah DPRD Parepare seharusnya lebih bijaksana dan menjadi mediator dalam menyelesaikan persoalan ini. Yayasan Sekolah Kristen Gamaliel sendiri telah memenuhi semua persyaratan yang dibutuhkan untuk mendirikan sekolah, sehingga penolakan ini dianggap tidak memiliki dasar hukum yang kuat.
“Pemerintah Kota Parepare seharusnya berterima kasih kepada Yayasan Sekolah Kristen Gamaliel yang telah berupaya mencerdaskan bangsa dengan membangun fasilitas pendidikan. Mereka membantu pemerintah dalam mewujudkan hak pendidikan yang layak bagi seluruh warga negara,” lanjutnya.
Terkait adanya kelompok yang menolak pembangunan sekolah dengan alasan agama, Rusdianto menegaskan bahwa alasan tersebut tidak dapat dibenarkan. Ia mengingatkan bahwa negara tidak boleh tunduk pada desakan kelompok-kelompok tertentu yang bertentangan dengan konstitusi dan undang-undang.
“Negara harus tegas dan memberikan kepastian hukum atas apa yang sudah ditetapkan, termasuk dalam hal ini pembangunan Sekolah Kristen Gamaliel yang telah memenuhi syarat,” tambahnya.
LBH PC GP Ansor Parepare mendesak DPRD dan Pemerintah Kota Parepare untuk mengambil langkah sesuai dengan konstitusi. Pasal 27 ayat (1) UUD 1945 menyatakan bahwa semua warga negara memiliki kedudukan yang sama di hadapan hukum dan pemerintahan.
Oleh karena itu, pembangunan Sekolah Kristen Gamaliel seharusnya difasilitasi, bukan ditolak.
