Notifedia.com, Parepare — Proses penerbitan izin operasional sekolah milik Yayasan Gamaliel di Kota Parepare terancam mandek tanpa kepastian hukum. Kuasa hukum Yayasan, Rusdianto Sudirman dari Kantor Hukum JJAR & Rekan, menuding Dinas Pendidikan Kota Parepare sebagai penghambat utama, lantaran hingga kini belum juga menerbitkan rekomendasi tertulis yang menjadi syarat krusial dalam proses perizinan.
“Klien kami sudah bolak-balik ke Dinas Pendidikan, tapi jawabannya selalu sama: menunggu petunjuk Wali Kota. Ironisnya, Wali Kota justru menyatakan itu merupakan kewenangan Dinas Pendidikan. Ini jelas sikap saling lempar tanggung jawab,” tegas Rusdianto, Jumat (11/7).
Padahal, menurutnya, Yayasan Gamaliel telah memenuhi seluruh persyaratan administratif dan teknis sebagaimana diatur dalam peraturan perundang-undangan, termasuk Permendikbudristek dan Perda yang berlaku. Tidak hanya itu, hasil rapat Forkopimda pada 30 Juni 2025 bahkan secara eksplisit menyepakati bahwa izin operasional sekolah Gamaliel harus segera diterbitkan.
“Yang kami hadapi bukan lagi masalah administrasi, tapi dugaan kuat pelanggaran terhadap asas-asas umum pemerintahan yang baik, seperti keterbukaan, kepastian hukum, dan pelayanan publik. Ini mengarah pada maladministrasi,” ujarnya.
Rusdianto menegaskan pihaknya siap menempuh jalur hukum, baik administratif maupun pidana, apabila terbukti terjadi penyalahgunaan wewenang atau unsur kesengajaan menghambat pelayanan publik. Ia menyoroti bahwa penundaan tanpa dasar hukum sah merupakan bentuk nyata pembiaran terhadap hak warga negara untuk memperoleh pelayanan setara.
“Ini bukan sekadar izin sekolah. Ini soal keadilan, pelayanan publik, dan integritas birokrasi. Jika tak ada tindakan segera, kami akan gugat,” ancamnya.
Yayasan Gamaliel sendiri dikenal sebagai lembaga pendidikan yang telah lama berkiprah di Parepare. Upaya mereka mendirikan satuan pendidikan baru merupakan bagian dari kontribusi dalam memperluas akses dan kualitas pendidikan di daerah.
“Pemerintah daerah seharusnya menjadi fasilitator pendidikan, bukan justru menjadi penghambat. Kami berharap ini bukan karena tekanan dari pihak-pihak yang merasa terancam oleh hadirnya sekolah baru,” tandas Rusdianto.
Pihak yayasan kini memberi tenggat waktu kepada Dinas Pendidikan dan Wali Kota Parepare untuk segera bertindak. Jika tidak, persoalan ini akan dibawa ke jalur hukum demi menjamin hak masyarakat dan menjaga kredibilitas sistem pemerintahan daerah.
